For my canada trip (by car), CBP-Us just checked my H1-B approval (passport had old exprired visa) and they let me in.
I think it's true only for entry by road.

Let us say someone has changed employers after 180 days of 485 application and has no plans to invoke AC21(which is optional) .
1)What is the process to switch attorneys(from Attorney A to Attorney B)?
OR alternatively
2)If we don't want to choose a new attorney, but want all the communictation(such as RFE to come to you), What is the process ?
I read somewhere that you can do this by filing a new G-28, but not sure of the step by step process and the documentation needed.
Appreciate as much details as possible from someone who did this.

1. Fill new G28 and singed by the applicant and the new attorney and send it to USCIS
2. Fiell new G28 form or send a letter to USCIS, saying that the current atttonreny on the file does not represent you any more and to send any future correspodence to the specified address. I think there is a separate P.O addresss you have to send this letter. Check the USCIS site

I am in a weird situation. My wife has green card and my child is a US Citizen and she has a PIO Card (Indian Green Card). I was on H-4 till my wife got the green card - however, I have been told that the H-4 is invalid as soon as the primary applicant receives the green card. I have received my EAD Card and I have completed the FP. For whatever reason, the lawyer did not apply for I-131 till Oct 12, 2007. Now he says, it will take 90 days. What documents should I be carrying while traveling to India to travel on AP (if I ever get one). Any response will be highly appreciated. Please help.

Lets say if campany A keeps paying me (runs my payroll with salary specified on my H1 petition) Will that keep my H1b alive and active when i work on EAD for company B ? ( Did i get that right )
Will USCIS know that i have switched jobs in between ?

Hi,
Need advice from an attorney:
My I-94 expires in december 2010. I have an approved Advance parole till Dec 2011(I485 is pending). Is it required to travel outside the country and get a new I-94 ?
2. Is there a source on the Net that I can refer to that explains this?

You don't have to travel outside. it is still legal to stay in the country.

I believe that you can travel to India - no need to worry. You can use your AP while returning - and it will work even if your GC has been approved. I personally saw this working for my friend couple of years back. He and his wife travelled to India - I was checking their mails for them. I received their GC while they were in India. They didn't have any problems in returning using AP.
I would also ask an immigration lawyer to double-check. All the best.

I am writing this Blog entry from my conference of the American Immigration Lawyers Association in Washington DC. In this past few days Immigration lawyers from across the nation gathered here in DC to share ideas and discuss our Immigration laws and policy. On Thursday not so far from our conference, the President (maybe he planned it), discussed Immigration reform for the first time in months.
President Obama stepped back into the political minefield of immigration policy Thursday, arguing for big changes in what he called a "broken" immigration system. But he warned that no such changes are possible without some Republican support.
From months now, Latino activists have been pushing the president to make good on his promise to overhaul the nation's immigration system. Thursday, in a speech at American University here in DC, Mr. Obama took up the challenge.
The speech followed meetings earlier in the week with immigration activists and Latino lawmakers.
To those concerned with security along the southern border with Mexico, Mr. Obama said, he's already put more boots on the ground than ever before. But, he argued, border enforcement by itself will not stop the flow of illegal immigrants.
Immigration is back in the spotlight now thanks to a new Arizona law requiring police to question anyone they suspect of being in the country illegally. Mr. Obama says he understands the frustration that led to that law, but he thinks Arizona went too far. His speech helped to lay the groundwork for an expected legal challenge by the Justice Department.
These are exciting times for all of us at the Immigration Bar, and being here in Washington makes you feel like part of the debate. I promise to keep you updated as we hear from USCIS officials and other government representatives on upcoming changes and other issues.

NetIP is a nationwide organization, though each chapter seems to function in a somewhat independent way. However, events that have been successful at one chapter tend to be taken up by other chapters.
The nationwide NetIP chairs did not respond to me, though the Bay Area president did.
Here is a list of chapters. There is a tri-state chapter.

Hello All,
I applied EAD for my wife in Dec Last Week. Case is still pending with USCIS. I have to move to a different state due to job change. I have put a forwarding adress with USPS. All my mail are getting forwarded.
My question is if EAD is approved will it also get forwarded to my new address as other mail or do i need to submit a change of address with USCIS.
Did any one faced this situatin before? Please advice and share your experiences.

Reciept notice should be recieved as soon as USCIS recieves the application. It shouldn't take much time though I kind of feel it should not take more than couple of days from USCIS part to send the reciept and then 4-5 days for postal reciept. I guess in about weekdays time after reciept at USCIS, you should recieve the notice.
This is just my understanding. Also some one said, you can start working for the new company as soon as your application is delivered to the USCIS. Get this confirmed by some one.

I would like to invite other EAD holders to work on 1099 and get maximum share through my company. As I was not able to get the higher billing working on 1099 individually.
