you have to options -
1. your employer files change of status H1 to H4 (form I-539)
2. you go out of country and come back on previously stamped H4. you need not to apply H4 again as long as previous H4 is valid. remember - if you decide to work in future, your employer has to file change of status application from H4 to H1 again.
please double check before you make any decision.

Here is my Situation;
me and my wife,both residents of singapore, have h1b approved this year through the same consultancy firm and the company has already received the approval notice. We are planning to appear for visa interview sometime end of this month with Singapore Embassy and the company is going to send all the documents by next week.
Since we both are going for visa interview, I have few concerns regarding our cases:
1 We both are planning to go for visa interview on the same day. So, who should go first so that it would not interfere others interview? Or does it really make any difference?
2 Will visa officer ask any of us that since you are married why you haven't bring your spouse together? Can we say that the other also has h1b interview on the same day?
3 I am not sure whether my wife would face any questions regarding that she is married and does she have any spouse issues or what if mine H1b is not going to approved? would she still be interested to pursue her h1b or like that?
4 My h1b was denied last year because of company project document issue with same singapore embassy. So I am not sure does it going to make any impact this time or not? Any help appreciated.

Just had an infopass appointment.
Me: Can you tell us the status of our 485s?
I/O: Name checks are pending for both
Me: Do you know when they were started?
I/O: At the time your application was submitted (duh!)
Me: Would our applications still be processed?
I/O: Yes, they are at TSC(duh!) and they are aware of the 6 month rule
Me: Are they assigned to an officer?
I/O: Right now they are with the officer"s" at Texas, as recently as July 31st, not too long ago.
Me: When do our fingerprints expire?
I/O: blank
I had enough by then.. dont think anything will happen to our apps this month. My wife will get a RFE, because of incomplete medicals (Xray), I was atleast hoping to get that RFE this month.

Hey all,
Saw August Visa Bulletin on Mid July.
Checked the appointments PDF in chennai consulate and did not see appointments for August yet.
Sent an email to Chennai consulate requesting when will my appointment be as per the new august bulletin and surprisingly they sent a reply saying that I was scheduled for August 11nth.
Started preparing for the interview. Told my employer and client that I am leaving to India for the interview.
Got the notarized copy of the employment letter.
Started on July24th and reached July25th night.
Got some sleep and went to local police station and applied for the PCC but the local police station asked too many question and gave me hard time.
Went to Lister Laboratory and took the medicals.
Went to local police station for atleast 10 times between saturday and Sunday following up but no proper answers
Got the results from Listor laboratory and went to the Doctor and got the medical report done.
Got frustrated and went to commissioners office on Monday and came to know that there is a official PCC format request in that office and applied for the same immediately.
Personally met ACP and explained the situation and he promised me to get the PCC the very next day.
went directly from the commisioner office to Passport office and applied for the PCC there too since the US consulate in chennai requested the PCC to be given form both passport office and the commissioners office.
Tuesday Morning got police verification for me and my wife in our homes.
Tuesday evening went to passport office and collected the PCC stamped in the passports and collected the PCC from them.
Went to Commissioners office and collected the PCC from there too.
Wednesday executed the secondary BCC affidavit since my name was not written on the BCC.
Wednesday took all the documents and went to local VFS office and submitted all the documents and paid courier fees.
Went to US Consulate on August 11th Morning around 7.30 AM.
We were let inside and asked to wait in the waiting room for couple hours now.
We were called around 10.00 AM and an Indian lady verified all the documents and asked for all the originals.
The original documents requested are BCC, PCC, Offer letter, Affidavit, Marriage photos, marriage invitation,.....
We told the officer that we have an infant and asked if it will take more time. The officer promised to call as first.
10.45 AM they called us around 10.45 and took finger printing for me and my wife.
11.15 AM an American lady officer called us and asked some questions like how long I have been in US, whom do I work for, whats my designation, and asked couple question to my wife.
Finally congratulated us and said they are issuing the immigration visa to us and that we will get our passports in a week and handed over all the original documents back to us.
Started from the consulate.
Started to US on last Thursday.
Reached on Thursday here at LAX port of entry.
Asked to wait for an hour.
took finger printing and asked us to get our baggage and waited in the waiting area.
One hour from there one officer called and said the passports are stamped and we are all set to go.
They told that the temporary visa is valid for one year and if I dont get the GC with in that time frame I should contact the local office then.
Job done.
Guys this forum was helpful to gather information and I wish all the very best for the ppl to sail smoothly and get their GC.

Thanks so much for taking time to respond. I have e-filed my application and am sending all supporting documents today. It appears that the processing time is about 90 days, so I might not be able to leave in Feb afterall. But at least I will have my Travel document ready for any future travel plans.

Yesterday, I received one more appointment notice for a different day (one day after the original appointment). This is in addition to the appointment notice that I had received earlier.
Has this happened to anybody before? Is it just a mistake on the part of USCIS? I am planning on going there as per the first notice.

I�m in EB2 and My I-140 was approved September 2008 through Employer A. My priority date is March 2008. I moved to Employer B. My old Employer A will not revoke my I-140. He is ready to hire me again, If I want to go back. I am completing 5 years in January 2011.
It would be great if I get answer the below my Question:
1. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.
2. If I stay with my current Employer B. will I get 6th extension and will my old priority date will be considered with new processs.
3. which one is best choice, like staying with employer B or going back to Employer A.

True and I don't blame them, my priority date is 10th August 2007 and I haven't seen much progress since then. Last year during advocacy day in washington the turn out was pretty low, let's hope we will have better turn out this year and will make our voice heard.
We pay all the taxes including social security being on work visa, why should we be made liable to pay these taxes when the beneifts will be reaped only by citizens. An individual should be made to pay SS taxes only after he becomes a permanent resident. We are made to pay each and every tax without getting anything in return except an ambiguos future for us and family.

Yes getting her here on an F1 Visa is your best option. You can hv the wedding in India but she shd not disclose abt her wedding and shd cm here on her maiden name and after afew months you can hv a registered marriage here. That is what my cousin did and they flew together to US.
