Hi,
I am currently on h1b visa without a project from past 1 year in US and my employer asked me to convert to L2 visa dependent on my husband who is on L1 visa . I do not have any paystubs for my stamping. If I go to canada consulate for stamping, what is the success rate for my visa being approved?Will I be able to come back to US without any issues.Also, can you suggest me to which consulate should I go for my stamping?Please help!

Seeing the enthusiasm of all the people on this message board, I would like to request IV Core to co-ordinate rallies in various cities by doing the following:
1. Facilitate a common date for all rallies through consensus
2. Facilitate the development of a common theme through consensus
3. Facilitate an official statement on our position on "employers that abuse the immigration system"
I propose that the San Jose rally organizers should act as advisors to other local chapters since they did a wonderful job organizing the rally.

My LC and I-140 was approved with my ex-employer in CA.Now I have a oppurtunity to join my ex-employer in the east coast. Will I be able to file AOS if I join in a similar role and when my PD becomes current ? The immigration lawyer of my ex-employer told me that I have to join in the same location as my LC was approved to take advantage of AOS as it is location specific. Is it true?

I have to agree that the back ground is a bit distracting, but the petal is a very cool shot. If this were my shot I would try a few things in Photoshop to change it up. Like maybe make the background black and try black and white? Something like that may add something to it. Just a thought. Don't give up on it there's something there it just has to be found-:)!!

Like PMAT mentioned, I-539 is to be used, and you can do it by yourself, if you'd like. Download the latest form from http://www.uscis.gov/files/form/ (immigration forms).
You will need, I-129, photocopy of your passport, your I-94 (current), Photocopy of Marriage certificate.

Hi guys,
I am new to this forum. I am a recruiter and I have a candidate for a position in the US who is close to getting an offer. Here is my situation, any help would be appreciated.
Candidate is a Canadian Citizen currently in the US working with TN (Nafta Visa)
He has renewed his TN 4 times.
He is now close to receiving an offer from my client, but his current company just filed his petition for a H1B visa.
Not sure what is best for him and new employer. Candidate just received an email from his HR that he can't travel during petition, but would the new job, he will need to go to Israel for training. Can he make a request to his current employer to withdraw his petition once he decides to change companies in order to do TN visa again?
Any help would me much appreciated.

I filed my I 485 on July 2nd. Now I have a very good offer from Company B. I have following questions and I seek your help -
1) Can I retain my PD?
2) If yes, what are the requirements and what is the process to retain the old PD?
3) Does the Company B have to file I 140 again?
4) What if Company A pulls back their I 140? Can they?
5) What are the risks?

MetteBB, I have not dropped the whole stamp thing. I have been pretty busy working on a research project for school, but I will have the stamps updated *soon*. Not sure when soon will be here, but I haven't forgotten about it :)

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

It's really impossible to answer this without knowing the exact employment relationship that is planned and what the denial said in detail. Presumably your employer has a lawyer who can advise on whether an appeal might be successful. It is very likely that the denial was based on there not being the correct "employer-employee" relationship. CIS issued a new memo on this last month, and there are many threads in this forum on the topic. The Agricultural Job Opportunities, Benefits, and Security (AgJOBS) Act has long served as a blueprint for comprehensive immigration reform. AgJOBS, which combines an earned legalization program for farmworkers with a reform of the H-2A temporary foreign agricultural worker program demonstrates a successful model for compromise where workers and employers have come together to resolve their differences. The dysfunctional U.S. immigration system is currently standing in the way of addressing deeper structural problems that impact U.S. workers and U.S. competitiveness in a globalized market. As Congress proceeds, here are a few facts about the current challenges at the intersection of immigration policy and agriculture, and why addressing these issues is critical to the nation�s economy.
Here is an interesting fact :Most farmworkers are not authorized to work legally in the U.S.
According to the National Agricultural Workers Survey (NAWS), conducted biannually by the Department of Labor, the share of seasonal agricultural workers who reported that they were unauthorized has increased dramatically in the last two decades, rising from 7% in Fiscal Year (FY) 1989, to 16% in FY 1990-91, to 28% in FY 1992-93. Hello All,
I am currently in H1-B. My GC (EB2) is in progress sponsored by my company.
The I-40 is approved but me and my wife�s I-485 is still pending.
We both got our EADs, but we have never-ever used it. We just applied for it and kept the card.
My wife was also on H1-B through her own employment. She got laid off so she is losing her H1-B. Now I want to apply for her H4 as my dependant. Since she already has an EAD, will applying for H4 nullify the EAD? As I said earlier that she has never used her EAD however she plans to use it when she gets a new job.
Anybody in similar situation? Any remarks or suggestion would be greatly appreciated.

My middle name is given only initial on not full on 1-485 ,131 receipt but 765 has full name
can any one advise me on how to resolve it.
I am on H1 now and my H1 B approval also had my middle name as initial.
Why are you worried? Dropping middle name in North American naming conventions is common, but that should not matter.
